1. Acceptance of Terms

  • Delivery Services: We offer home and business delivery of food orders within our designated service areas. Delivery availability, fees, and estimated times may vary based on location, time, and demand.
  • Carryout/Pickup Services: Customers may place orders online for in-store pickup at participating Jet's Pizza locations.
  • Account Management: Users may create personal accounts to manage their order history, save delivery addresses, store payment preferences, and access promotional offers.
  • Promotional Programs: From time to time, we may offer discount codes, loyalty rewards, limited-time deals, or other promotional programs subject to their own terms and conditions.
  • Customer Support: We provide customer service assistance via email and other designated communication channels to assist with order inquiries, complaints, and general questions.

We reserve the right to modify, suspend, or discontinue any aspect of our Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

Our Platform may contain links to third-party websites, services, or payment processors. These third-party services operate under their own terms and privacy policies, and we are not responsible for their content, practices, or availability.

3. Eligibility and User Obligations

3.1 Eligibility

To use our Service, you must be at least eighteen (18) years of age or the age of majority in your jurisdiction, whichever is greater. By using the Service, you represent and warrant that you meet this age requirement. Users under the age of thirteen (13) are strictly prohibited from creating accounts or providing personal information on our Platform, in compliance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506.

You must also be a legal resident or present within the United States and provide accurate and complete information when creating an account or placing an order.

4. Prohibited Activities

You agree that you will not, under any circumstances, engage in any of the following activities when using our Platform or Service:

Intellectual Property Violations Reproducing, distributing, modifying, or creating derivative works based on our proprietary content, trademarks, or intellectual property without authorization.
Harassment and Abuse Harassing, threatening, or intimidating our staff, other users, or any third party; posting or transmitting offensive, defamatory, or harmful content.
Commercial Misuse Using our Platform for unauthorized commercial solicitation, spam, or unsolicited marketing communications directed at other users.
Misrepresentation Providing false information about allergies, dietary restrictions, or other order details with the intent to defraud or manipulate our Service.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates any of these prohibited activities, including removing the offending content, suspending or terminating accounts, and reporting violations to law enforcement authorities as required or permitted by law.

5. Ordering, Payment, and Pricing

5.1 Order Placement

When you place an order through our Platform, you are making an offer to purchase food and beverage products in accordance with these Terms. All orders are subject to availability and our acceptance. We reserve the right to refuse or cancel any order at our discretion, including but not limited to situations involving pricing errors, suspected fraud, or unavailability of items.

Once your order is confirmed, you will receive an electronic confirmation via email or through the Platform. This confirmation constitutes our acceptance of your order and the formation of a binding contract between you and Jet's Pizza for the purchase of the specified items.

5.2 Pricing and Taxes

All prices displayed on our Platform are in United States Dollars (USD) and are subject to change without prior notice. We make every effort to ensure that prices are accurate; however, in the event of a pricing error, we reserve the right to cancel orders placed at incorrect prices and notify affected customers accordingly.

Applicable federal, state, and local sales taxes will be calculated and applied to your order total based on your delivery or pickup location. You are responsible for all taxes applicable to your purchase as required by applicable law.

5.3 Payment Methods

We accept various payment methods as displayed on the Platform, which may include major credit cards, debit cards, and other electronic payment options. By providing payment information, you represent and warrant that:

  • You are legally authorized to use the payment method provided;
  • The payment information you provide is accurate and complete;
  • You authorize us to charge the applicable amounts to your designated payment method.

Payment processing is handled by third-party payment processors who maintain their own security standards and privacy policies. We do not store complete payment card information on our servers.

5.4 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been confirmed and preparation has commenced. If you believe there is an error with your order, you must contact us within a reasonable time after receipt at [email protected]. Refund eligibility will be determined on a case-by-case basis at our sole discretion, subject to applicable consumer protection laws.

6. Delivery Services and Service Areas

Delivery services are available within designated service areas only. Delivery fees, minimum order requirements, and estimated delivery times are subject to change based on location, time of day, and operational conditions. We do not guarantee specific delivery times and shall not be held liable for delays caused by factors beyond our reasonable control, including but not limited to traffic conditions, weather events, or force majeure circumstances.

You are responsible for providing accurate delivery address information. We are not responsible for failed deliveries resulting from incorrect address information provided by you. In such cases, you may not be entitled to a refund.

Risk of loss and title for food items pass to you upon delivery to the address provided. We are not responsible for the quality of food items after delivery has been completed.

7. Intellectual Property Rights

All content, materials, and intellectual property available on or through our Platform are the exclusive property of Jet's Pizza or its licensors and are protected under applicable United States intellectual property laws, including the Copyright Act (17 U.S.C. § 101 et seq.), the Lanham Act (15 U.S.C. § 1051 et seq.), and applicable state laws.

The following elements, without limitation, are proprietary to Jet's Pizza and may not be used without express written authorization:

  • The "Jet's Pizza" name, logo, trade names, trademarks, and service marks;
  • Website design, layout, graphics, images, and visual elements;
  • Menu descriptions, photography, and food styling;
  • Marketing materials and advertising copy;
  • Software, source code, databases, and technical architecture underlying the Platform;
  • Proprietary recipes, formulations, and trade secrets (to the extent not publicly disclosed).

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial purposes of ordering food and related services. This license does not permit you to:

  • Copy, reproduce, or distribute any portion of the Platform or its content;
  • Modify or create derivative works based on our content;
  • Use our trademarks or branding in any manner without prior written consent;
  • Reverse engineer, decompile, or disassemble any software components of the Platform;
  • Remove or alter any proprietary notices or labels on our content.

Any unauthorized use of our intellectual property may subject you to civil and criminal liability under applicable law. We actively monitor and enforce our intellectual property rights.

8. Disclaimers and "As-Is" Basis

THE SERVICE AND ALL CONTENT, PRODUCTS, AND FEATURES AVAILABLE THROUGH OUR PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JET'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY: We do not warrant that our products or services will meet your expectations or requirements;
  • FITNESS FOR A PARTICULAR PURPOSE: We do not warrant that our Platform or products are suitable for any specific use or purpose you may have;
  • NON-INFRINGEMENT: We do not warrant that use of our Platform will not infringe the rights of any third party;
  • ACCURACY AND RELIABILITY: We do not warrant that the information on our Platform, including menu descriptions, allergen information, pricing, and availability, is always accurate, complete, or current;
  • UNINTERRUPTED SERVICE: We do not warrant that our Platform will be available continuously, free from errors, or secure from unauthorized access.

Allergen and Dietary Information Disclaimer: While we make reasonable efforts to provide accurate allergen and nutritional information, we cannot guarantee that our products are free from specific allergens due to the risk of cross-contamination in our preparation facilities. Customers with food allergies or dietary restrictions are strongly advised to contact us directly before placing orders to assess the suitability of our products for their specific needs. We shall not be liable for any allergic reactions or adverse health effects resulting from consumption of our products where such risk has been communicated or should reasonably have been known.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE FEDERAL AND STATE LAW, INCLUDING THE LAWS OF THE UNITED STATES, JET'S PIZZA AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES of any kind whatsoever, including lost profits, lost revenue, loss of data, loss of goodwill, or business interruption;
  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE our Platform, Service, or products;
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS to or alteration of your transmissions or data;
  • DAMAGES CAUSED BY THIRD-PARTY CONDUCT, including delivery drivers, payment processors, or other service providers;
  • PERSONAL INJURY OR PROPERTY DAMAGE arising from your use of our products or services, except to the extent required by applicable consumer protection law.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

The limitations of liability set forth in this section shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.

Nothing in these Terms shall limit or exclude our liability for fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its owners, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service or any applicable law or regulation;
  • Your use or misuse of the Platform, Service, or any products purchased through our Platform;
  • Your violation of any third-party rights, including intellectual property rights, privacy rights, or consumer rights;
  • Any content you submit, post, or transmit through the Platform;
  • Your negligence, willful misconduct, or fraudulent conduct;
  • Any dispute between you and another user of the Platform or any third party;
  • Your breach of any representations or warranties made in these Terms.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense of such claims. You may not settle any claim subject to indemnification without our prior written consent.

11. Governing Law and Jurisdiction

These Terms of Service and any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Platform or Service, shall be governed by and construed in accordance with the laws of the United States of America and applicable state laws, without giving effect to any conflict of law principles that would require application of the laws of any other jurisdiction.

To the extent that any judicial proceeding is permitted under these Terms, you consent to the personal jurisdiction of courts located within the United States for the resolution of any disputes. You waive any objection to venue or jurisdiction on the grounds of inconvenience or otherwise.

Our Platform and services are intended for use by residents of the United States. We make no representation that the Platform or its content is appropriate or available for use in locations outside the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with all applicable local laws.

These Terms are subject to applicable federal law, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 45 et seq.), which prohibits unfair or deceptive acts or practices in or affecting commerce, and we are committed to complying with all FTC guidelines and regulations applicable to our business operations.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute, claim, or controversy informally by contacting us at [email protected]. We will make good-faith efforts to resolve the matter within thirty (30) days of receiving your written notice describing the nature of the dispute and your desired resolution. This informal dispute resolution process is a prerequisite to initiating any formal arbitration or legal action.

12.2 Binding Arbitration

IF INFORMAL RESOLUTION IS UNSUCCESSFUL, YOU AND JET'S PIZZA AGREE THAT ANY REMAINING DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL BE FINALLY RESOLVED BY BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT, except as otherwise provided below. The arbitration shall be conducted by a recognized arbitration organization under its applicable rules and procedures in effect at the time the arbitration is initiated.

The arbitrator shall have the authority to grant any remedy or relief that a court of competent jurisdiction could order or grant, subject to the limitations set forth in these Terms. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator shall not consolidate more than one person's claims and shall not preside over any form of class or representative proceeding.

12.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or proprietary data. Small claims court actions are also excluded from the arbitration requirement.

13. Term and Termination

These Terms are effective from the date you first access or use our Platform and shall remain in full force and effect until terminated in accordance with this section.

You may terminate your relationship with us at any time by discontinuing use of the Platform and, if applicable, deleting your account. Please note that termination of your account does not relieve you of any obligations or liabilities accrued prior to termination.

We reserve the right, in our sole discretion, to suspend or terminate your access to the Platform and/or your account at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or any applicable law or regulation;
  • Fraudulent, abusive, or harmful conduct;
  • Non-payment of amounts owed to us;
  • Requests by law enforcement or government authorities;
  • Extended periods of account inactivity;
  • Discontinuation or material modification of the Service;
  • Technical or security issues or problems.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.

14. Changes to Terms

We reserve the right to modify, update, or replace these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will notify you by:

  • Posting the updated Terms on our Platform with a revised "Last Updated" date;
  • Sending an email notification to the address associated with your account, where applicable;
  • Displaying a prominent notice on our Platform alerting users to the changes.

Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform immediately. We encourage you to review these Terms regularly to stay informed of any modifications.

For significant changes that materially affect your rights or obligations, we will provide at least thirty (30) days' advance notice before the changes take effect, where practicable. Changes required by applicable law may take effect immediately.

15. Privacy and Data Protection

Our collection, use, storage, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated into and forms part of these Terms. By using our Service, you consent to the collection and use of your information as described in our Privacy Policy.

We comply with applicable federal and state privacy laws, including applicable provisions of the Federal Trade Commission Act and state consumer privacy laws applicable to our operations. We do not sell your personal information to third parties for monetary consideration without your explicit consent.

We implement reasonable and appropriate technical and organizational security measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

16. Force Majeure

Jet's Pizza shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, floods, earthquakes, or severe weather events;
  • Pandemic, epidemic, or public health emergencies;
  • Acts of war, terrorism, civil unrest, or government action;
  • Strikes, labor disputes, or supply chain disruptions;
  • Interruptions to internet, telecommunications, or power infrastructure;
  • Regulatory changes or government-imposed restrictions affecting food service operations.

In the event of a force majeure occurrence, we will notify you as soon as reasonably practicable and take reasonable steps to minimize the impact on your orders and our service delivery.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other policies or guidelines incorporated by reference herein, constitute the entire agreement between you and Jet's Pizza with respect to your use of the Platform and Service, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the same subject matter.

No failure or delay on the part of Jet's Pizza in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege.

18. Severability

If any provision of these Terms of Service is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable under any applicable law or regulation, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The invalid, illegal, or unenforceable provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

In such an event, the invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the original intent and economic effect of the severed provision, to the extent permitted by applicable law.

The parties acknowledge that they would have entered into this Agreement even without any provision found to be invalid or unenforceable, and that the removal of such provision does not fundamentally alter the nature of the agreement between the parties.

19. Waiver

No waiver by Jet's Pizza of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. The failure of Jet's Pizza to insist upon or enforce strict performance of any provision of these Terms shall not be construed as a waiver of any right or remedy in respect of any subsequent default or failure of performance.

20. Assignment

You may not assign, delegate, or transfer these Terms, your rights hereunder, or your account to any third party without our prior written consent. Any purported assignment in violation of this provision shall be null and void. Jet's Pizza may freely assign these Terms or any of its rights or obligations hereunder without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. These Terms shall be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.
